These Terms of Use govern the use of mobile applications, cloud services and IoT systems provided by Logica H&S S.r.l., including, but not limited to, HumiCONTROL, MoistAPP and future industrial monitoring and control applications (hereinafter referred to as the "Service").

Use of the Service implies full acceptance of these Terms.

1. SUBJECT OF THE SERVICE

The Service enables the monitoring, visualization, storage and management of technical data from connected devices and systems.

Logica H&S reserves the right to modify, update or improve the Service at any time.

2. REGISTRATION AND ACCOUNT

To use the Service, an account must be created.

The user is responsible for:

• the accuracy of the information provided;

• the confidentiality of login credentials;

• all activities carried out through their account.

Logica H&S may suspend or deactivate an account in case of misuse or violation of these Terms.

3. PROPER USE OF THE SERVICE

The user agrees to:

• use the Service in compliance with applicable laws;

• not attempt unauthorized access to systems or devices;

• not carry out reverse engineering, tampering or alteration of the software.

 

4. SERVICE AVAILABILITY

The Service is provided via cloud infrastructure and network connections.

Logica H&S does not guarantee continuous and uninterrupted availability of the Service.

Interruptions may occur due to:

• technical maintenance;

• software updates;

• connectivity issues;

• force majeure events.

 

5. LIMITATION OF TECHNICAL LIABILITY (IoT SYSTEMS)

The Service provides data and tools supporting technical decision-making.

The user remains fully responsible for:

• proper installation of devices;

• system maintenance;

• verification of received data;

• technical supervision of monitored systems.

The Service does not replace certified safety systems, manual inspections or professional supervision.

Logica H&S shall not be liable for direct or indirect damages arising from:

• incorrect installation;

• improper use of the system;

• hardware malfunctions;

• network or cloud service interruptions;

• incorrect interpretation of data.

 

6. INTELLECTUAL PROPERTY

The software, trademarks, content and technologies used in the Service are the exclusive property of Logica H&S.

Any unauthorized reproduction, distribution or use is prohibited.

 

7. CHANGES TO THE TERMS

Logica H&S may update these Terms at any time.

Changes become effective on the date of publication.

Continued use of the Service implies acceptance of such changes.

 

8. GOVERNING LAW AND JURISDICTION

These Terms are governed by Italian law.

For any dispute, the Court of Udine shall have exclusive jurisdiction, unless otherwise required by law.
